Draft Amendment 8 (54 Luchetti Avenue, Hazelbrook) to Blue Mountains Local Environmental Plan 2015

Consultation has concluded.

Council has received a Planning Proposal for 54 Luchetti Avenue, Hazelbrook to rezone part of the site from E2 Environmental Conservation to E4 Environmental Living. This Planning Proposal is known as Draft Amendment 8 to LEP 2015.

As a result of the proposed rezoning of E2 on 54 Luchetti Avenue, it is being proposed that small area of E2 on adjoining lots to the south be also rezoned. In addition, the proposal seeks to remove the Protected Area – Ecological buffer associated with the E2 zone on both 54 Luchetti Avenue and 13 adjoining lots as outlined in the Planning Proposal.

The Planning Proposal was presented to the 22 August 2017 Council meeting where it was endorsed to send to the Greater Sydney Commission to seek a Gateway Determination.

A Gateway Determination was subsequently received by Council for the Planning Proposal on 27 October 2017.

While the Gateway Determination for Draft Amendment 8 to LEP 2015 only requires a 14 days public exhibition period, the planning proposal will remain on exhibition for an additional 17 days in accordance with Council’s policy on community consultation which falls within the Christmas period. Therefore, the planning proposal will be on exhibition for a total of 34 days, from Wednesday 6 December 2017 to Monday 8 January 2018.

    Adevelopment application for a one into seventeen lot subdivision for 54 Luchetti Avenue, Hazelbrook which was recently approved by the Land and Environment Court, subject to a number of conditions. As a result of investigations conducted as part of the court case, it was established that scheduled vegetation, supporting the application of the E2 zone on the site, is no longer present.
