Summary of Draft Amendment 5 to Blue Mountains Development Control Plan 2015

Draft Amendment 5 to Blue Mountains Development Control 2015 (DCP) proposes the following changes, which fall into three categories as noted below:
A.
Proposed changes to Part G of the DCP - Locality Management (Employment Lands)
Additional precincts specific controls are proposed in response to State Government changes to the NSW planning system for business and industrial areas.
B.
Proposed amendment to Part E of the DCP - Site Development and Management (Waste Management)
These proposed amendments update and align with current requirements and best practice.
C.
Proposed general DCP Housekeeping
Consequential referencing and administrative corrections are required as a result of the proposed changes A and B above. Minor housekeeping corrections are also proposed.


At the October 2022 Ordinary Council Meeting, Council endorsed this draft DCP amendment for public exhibition to seek the community's feedback on these proposed amendments. DCP 2015 Draft Amendment 5 is on public exhibition from 7 November 2022 until 9 December 2022

Background on the proposed changes to DCP 2015

A. Overview of proposed changes to Part G of the DCP - Locality Management (Employment Lands)

The proposed Amendment 5 to Part G of the DCP responds to State Government Employment zones reform, which is translating current Business (B) and Industrial (IN) zones into newly named Employment (E) zones.

  • On 1 December 2022, this reform package amends the Blue Mountains Local Environmental Plan 2015 (LEP), with a deferred commencement of 26 April 2023
  • All LEPs across the State will be amended to a new framework. More detail about the State led employment zones framework can be viewed here
  • The proposed amendments to Part G of the DCP are being undertaken to align with the LEP reform framework changes
  • The LEP reform reduces the number of Employment zones which reduces the differentiation between the industrial areas and business areas within the Blue Mountains. The proposed additional precinct specific controls are required to maintain place-based local planning controls
  • Proposed amendments to Part G of the DCP will create precincts in business and industrial zoned areas where there are currently no precinct provisions and are intended to retain the small scale and local focus of each of these areas
  • In addition, the proposed controls are consistent with and supplement the draft precinct objectives that will be introduced into LEP 2015 as part of the employment land zone reform process

B. Overview of proposed amendment to Part E of the DCP - Site Development and Management (Waste Management)

The Waste Management component of the DCP was last reviewed in 2016. The proposed DCP revision seeks to:

  • Ensure compliance requirements are met and effective waste management provisions are in place when assessing development proposals
  • Improve readability for customers
  • Resolve inconsistencies and gaps
  • All proposed changes reflect the objectives of Council’s Towards Zero Waste Strategy and commitment to reducing waste to landfill and supporting a circular economy
  • The proposed change to Part E of the DCP can be viewed in the document library to the right hand side of this page


C. Overview of proposed general DCP Housekeeping
A consequence of the proposed changes to the DCP is that there will be minor administrative changes to the document. These changes include:

  • Section headings, page numbering and section numbering
  • Re-ordering and/or creating a contents page and content pages, related to Part G amendments
  • General administrative errors or corrections noted while reviewing the DCP
  • Updates to legislative changes, such as clause references or statutory document name changes
  • The proposed general housekeeping changes can be viewed in the document library to the right hand side of this page
