Draft Amendment 10 to Blue Mountains Local Environmental Plan 2015

Council has prepared a planning proposal to amend clause 4.1G Lot consolidation in certain environmental protection zones of LEP 2015 and on 13 July 2018 the Department of Planning issued a Gateway Determination meaning Council can proceed with the community consultation of Amendment 10.
The objective of Amendment 10 is to make minor alterations to clause 4.1G to reinstate the provision and outcome that were present in LEP 1991 and LEP 2005 but was unintentionally removed in the drafting of LEP 2015.
There are two issues that, when amended, will restore development potential as it existed in the previous LEP’s. The amendments proposed are:
Including land in zone E2 Environmental Conservation in the clause and in the area calculations;
Including land in zone IN1 General Industrial; and
Including two new provisions in Schedule 1.

The community consultation of draft Amendment 10 is for a period of 14 days commencing on Wednesday 12 September and concluding on Wednesday 26 September 2018.

The Gateway Determination conditionally authorises Blue Mountains City Council as the local plan-making authority to exercise its functions under section 3.36(2) of the Environmental Planning and Assessment Act 1979.
